Terms of Service

1. Acceptance of Terms

By installing, accessing, or using Cmdop (the "Service"), you agree to be bound by these Terms of Service. If you use Cmdop on behalf of an organization, you represent and warrant that you have the authority to bind that organization.

2. Service Nature and Disclaimer

Cmdop provides a non-deterministic interface for command generation. All output generated by Cmdop is probabilistic in nature and provided for convenience only.

THE SERVICE IS PROVIDED ON AN "AS-IS" AND "AS-AVAILABLE" BASIS. TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, CMDOP DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, ACCURACY, OR RELIABILITY.

3. User Responsibility and Execution

You represent and warrant that you possess the technical expertise necessary to evaluate any command or output generated by Cmdop. Your execution of any command is a voluntary, independent act that supersedes any suggestion provided by the Service.

SUGGESTIONS ARE NOT VERIFIED FOR SAFETY, SYNTAX, INTENT, OR SUITABILITY FOR ANY ENVIRONMENT. CMDOP DOES NOT PROVIDE ENGINEERING, OPERATIONAL, OR PROFESSIONAL ADVICE.

4. No Duty to Monitor or Warn

Cmdop does not undertake any duty to monitor, evaluate, warn, or intervene regarding potentially destructive, unsafe, or incorrect commands, including but not limited to commands affecting data deletion, system shutdown, or infrastructure modification.

5. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL CMDOP OR ITS AFFILIATES BE LIABLE FOR ANY DIRECT, INDIRECT, INCIDENTAL, CONSEQUENTIAL, SPECIAL, EXEMPLARY, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO DATA LOSS, SYSTEM FAILURE, BUSINESS INTERRUPTION, SECURITY BREACHES, OR INFRASTRUCTURE DAMAGE ARISING OUT OF OR RELATED TO THE USE OF THE SERVICE.

IF LIABILITY CANNOT BE DISCLAIMED AS A MATTER OF LAW, CMDOP'S TOTAL AGGREGATE LIABILITY SHALL NOT EXCEED THE GREATER OF (A) THE AMOUNT PAID BY YOU FOR THE SERVICE IN THE 12 MONTHS PRECEDING THE CLAIM OR (B) USD $100.

6. Indemnification

You agree to indemnify, defend, and hold harmless Cmdop and its officers, directors, employees, agents, and affiliates from and against any and all claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys' fees) arising out of or related to your use of the Service, your violation of these Terms, or your violation of any rights of another.

7. Prohibited Use

You may not use Cmdop to:

  • Gain unauthorized access to systems or networks
  • Develop, distribute, or execute malware
  • Violate applicable laws or regulations
  • Circumvent third-party service safeguards or usage limits

8. Export Controls and Sanctions

Cmdop may not be used in jurisdictions subject to U.S. trade sanctions or by individuals or entities listed on applicable restricted-party lists, including but not limited to Specially Designated Nationals (SDN).

9. Third-Party AI Providers

Cmdop utilizes third-party AI model providers. We are not liable for outages, performance degradation, inaccuracies, or unexpected outputs ("hallucinations") caused by third-party AI model providers. Such events constitute force majeure.

10. Suspension and Termination

We reserve the right to suspend or terminate access to the Service at any time, with or without notice, at our sole discretion.

11. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Delaware, United States, without regard to conflict of law principles.

12. Dispute Resolution

Any dispute arising out of or relating to these Terms or the Service shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association. The arbitration shall take place in Delaware, United States. You waive any right to participate in a class action lawsuit or class-wide arbitration.

13. Severability

If any provision of these Terms is held to be invalid or unenforceable, such provision shall be struck and the remaining provisions shall be enforced to the fullest extent under law.

14. Survival

Sections relating to disclaimers, limitation of liability, indemnification, governing law, dispute resolution, and user responsibility shall survive termination of these Terms.

15. Entire Agreement

These Terms constitute the entire agreement between you and Cmdop regarding the Service and supersede all prior agreements and understandings.

16. Changes to Terms

We reserve the right to modify these Terms at any time. Continued use of the Service after such modifications constitutes acceptance of the updated Terms.
